What is the Establishment of Community Titles Scheme?
The original owner organises for either a solicitor or in some cases Capitol Body Corporate Administration to prepare the First CMS the for a community titles scheme. The document includes by-laws, drawings prepared by a Surveyor for Easements, Exclusive Use Plans & Service Location Diagrams.
The First CMS is signed by the original owner and the Survey Plan is signed and sealed by the Surveyor and the Original Owner. Both are then lodged with the local authority (council) which may take 2 to 3 weeks to be checked with the Development Approval documents & signed.
Once the local authority signs the First CMS & Survey Plans these are then lodged with the Dept of Natural Resources (DNR) for registration, this process may take a further 3 – 5 days for signing the First Community Management Statement.
What are the requirements for Community Management Statement?
In addition to identifying the scheme land the CMS generally states the following:
- the name of the body corporate
- the name and address of the original owner
- the regulation module
- includes a contribution schedule and an interest schedule
- includes the by-laws
- if the contribution schedule lot entitlements for each lot are not equal, explain why they are not equal
- a copy of the services location diagrams
- a copy of the exclusive use plans
- identifies easements
What needs to be done to comply with the Body Corporate and community Management (BCCM) Act?
The Original Owner provides for the body corporate records, all documents, plans, contracts and information about contractors and the development. A detailed list of the documents to be provided may be obtained from Capitol Body Corporate Administration at any time prior to handover.
